FomnyBox respects the intellectual property rights of others and expects the same from its users. This page explains how to notify us of allegedly infringing material and how we will respond.

Important context

FomnyBox is a directory of embeds. We do not host, encode, upload, or transmit the video streams shown on the site. Each player is an iframe embed sourced from the channel’s own public broadcast, its official YouTube live stream, or another publicly available source provided by the rights-holder. If you are the rights-holder and a stream has been posted publicly somewhere else without your permission, the most effective remedy is usually a takedown to that source (YouTube, the upstream CDN, etc.) — the embed on FomnyBox will then stop working automatically.

That said, if you would prefer that an embed be removed from FomnyBox regardless, we will act on a properly-formed notice within a reasonable time, typically within a few business days.

Filing a takedown notice

To be actionable under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent regimes in other countries, your notice must include all of the following:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. The exact URL(s) on fomnybox.com where the allegedly infringing material appears. Links to other sites are not enough.
  3. Your full name, postal address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
  6. Your physical or electronic signature.

Counter-notification

If you believe material was removed in error, you may submit a counter-notice that includes:

  1. Identification of the material that was removed and its previous location.
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  3. Your full name, address, phone number, email, and a statement consenting to the jurisdiction of the appropriate court.
  4. Your physical or electronic signature.

Repeat infringers

We will, in appropriate circumstances, restrict access for users or submitters who repeatedly send links or material that infringes the rights of others.

False notices

Submitting a knowingly false notice can expose the sender to substantial legal liability under 17 U.S.C. § 512(f) and equivalent laws elsewhere. Please make sure the material is actually yours and that the use is not covered by fair use, fair dealing, or licence before filing.
